La Justicia revocó la orden de retirada de 170 indios guaraní-kaiowá de las tierras en que viven en el estado de Mato Grosso do Sul.

En una carta a la opinión pública ellos expusieron: “Pedimos al Gobierno y a la Justicia Federal que no decreten la orden de desalojo, sino que decreten nuestra muerte colectiva y el enterramiento de todos nosotros aquí. Nosotros ya hemos evaluado nuestra situación actual y hemos concluido que vamos a morir todos, incluso dentro de poco tiempo”.

La muerte precoz, inducida -la que nosotros, caraspálidas, llamamos suicidio- es un recurso frecuente adoptado por los guaraní-kaiowá para resistir frente a las amenazas que sufren. Prefieren morir a degradarse. En los últimos veinte años casi mil indígenas, la mayoría jóvenes, pusieron fin a sus vidas en protesta por las presiones de empresas y terratenientes que codician sus tierras.
La carta de los guaraní-kaiowá fue divulgada después que la Justicia Federal determinara la retirada de 30 familias indígenas de la aldea Passo Piraju, en Mato Grosso do Sul. Dicha área es disputada por indígenas y terratenientes. En el 2002, por un acuerdo con la mediación del Ministerio Público Federal, en Dourados, se destinaron a los indígenas 40 hectáreas ocupadas por una hacienda. El supuesto propietario recurrió a la Justicia.
Según el CIMI (Consejo Indígena Misionero), vinculado a los obispos brasileños, hay que saber interpretar el lenguaje de los indios: “Ellos hablan de muerte colectiva (que es diferente del suicidio colectivo) en el contexto de la lucha por la tierra, o sea si la Justicia y los pistoleros contratados por los terratenientes insisten en sacarlos de sus tierras tradicionales, están dispuestos a morir todos en ellas, sin abandonarlas nunca”, dice la nota.
Datos del CIMI indican que, entre el 2003 y el 2011, fueron asesinados en el Brasil 503 indios. Más de la mitad -279- pertenecían a la etnia guaraní-kaiowá. Como protesta, el 19 de octubre, en Brasilia, fueron plantadas cinco mil cruces en el engramado de la Explanada de los Ministerios, simbolizando a los indios muertos y amenazados.
Están comprobados los asesinatos de miembros de esa etnia por pistoleros al servicio de los terratenientes de la región. Junto al río Hovy recientemente fueron asesinados dos indios mediante golpes y torturas.
La Constitución acepta el principio de la diversidad y la alteridad, y consagra el derecho congénito de los indios sobre las tierras habitadas tradicionalmente por ellos. Esas tierras debieron haber sido demarcadas hasta 1993, pero desgraciadamente la Justicia brasileña es extremadamente morosa cuando se trata de los derechos de los pobres y excluidos.
Un cuarto de siglo después de la aprobación de la carta constitucional, en 1988, las tierras de los guaraní-kaiowá todavía no fueron demarcadas, lo que favorece la invasión de ladrones y acaparadores de tierras y agentes del agronegocio.
Durante el gobierno de Lula participé en toda la polémica en torno a la demarcación de Raposa Serra do Sol. Gracias a la decisión presidencial y a una sentencia del Tribunal Supremo Federal, los terratenientes invasores fueron retirados de aquella reserva indígena.
En el caso de los guaraní-kaiowá no se ve, hasta ahora, la misma firmeza del poder público. Incluso la Abogacía General de la Unión, responsable de la salvaguarda de los pueblos indígenas -dado que ellos son tutelados por la Unión- llegó a editar un estatuto que en la práctica reduce el ejercicio de varios derechos.
El argumento de los enemigos de nuestros pueblos originarios es que sus tierras podrían ser económicamente productivas. Argumento tras el cual perdura la idea de que los indios son personas inútiles, descartables, y que el interés del lucro del agronegocio debe estar por encima de la sobrevivencia y de la cultura de dichos pueblos ancestrales.
Los indios no son extranjeros en las tierras del Brasil. Cuando llegaron aquí los colonizadores portugueses -equivocadamente calificados en los libros de historia como “descubridores”- se encontraron con más de cinco millones de indígenas, que dominaban centenares de idiomas distintos. La mayoría fue víctima de un genocidio implacable, quedando hoy apenas 817 mil indígenas, de los que 480 mil viven en aldeas, divididos entre 227 pueblos que dominan 180 idiomas diferentes y que ocupan el 13% del territorio brasileño.
Para nada sirve que el gobierno brasileño firme documentos en favor de los derechos humanos y del desarrollo sustentable si eso no se traduce en gestos concretos para la preservación de los derechos de los pueblos indígenas y de nuestro medio ambiente.
Hizo bien la presidenta Dilma al introducir retoques en el proyecto del nuevo Código Forestal aprobado por el Congreso. Entre agradar a los políticos y los intereses de la nación y la preservación ambiental, la presidenta no dudó en descartar privilegios y abrazar los derechos colectivos.
Ahora queda por demostrar la misma firmeza en la defensa de los derechos de esos pueblos que constituyen nuestra raíz y que marcan predominantemente el DNA del brasileño, según comprobó el Proyecto Genoma Humano.
