La novela de la Tierra Indígena (TI) de Maraiwatsede, de los indios Xavante, en el municipio de Alto Boa Vista, en la región Norte Araguaia, Mato Grosso, cada día tiene nuevos capítulos. A principios de la semana pasada, un grupo, formado sobre todo por mujeres, se manifestó en la Plaza de los Tres Poderes, en Brasilia, buscando revertir la decisión del Supremo Tribunal Federal (STF) que anula la anterior sentencia del Tribunal Federal Regional (TRF 1 º), que suspendía la decisión judicial de salida (retirada de los no indígenas) del área. El dia 5 ellas invadieron la pista frente a Planalto, Palacio Presidencial, y bloquearon el tráfico durante unos minutos.

A su regreso de Brasilia, el dia 9, irritados y enojados por no haber conseguido lo que querían, estos manifestantes hablaban, sin preocuparse de los otros pasajeros en el autobús, contra los indios y la Prelatura de São Félix do Araguaia. En un momento uno de ellos dijo: “Sabemos que todo esto es culpa del obispo Pedro, pero vamos a resolver esto bastante fácil, vamos a hacer una breve visita a él.”

Las amenazas no son novedad, pero esta adquiere un carácter más grave, pues los invasores de la zona indígena, después de haber logrado durante casi dos décadas, crear todos los embargos legales posibles contra su retirada, ahora están desesperados, pues el final está próximo.

El 3 de noviembre, el hijo del jefe indio Damian, al volver de Barra do Graças, donde había ido a dejar indígenas para tratamientos, fue perseguido por dos vehículos conducidos por personas que él reconocio eran del Posta da Mata, núcleo de la invasión del territorio indio Maraiwatsede . Más adelante, otros tres coches intentaron cercar y parar el vehículo dirigido por él. Al tratar de escapar de la persecución, el coche volcó, quedando el indígena inconsciente. Los camioneros que pasaban por alli socorrieron al conductor. El vehículo fue quemado finalmente por los perseguidores.

La historia de las agresiones contra los Xavante de Maraiwatsede se prolonga por casi medio siglo. Su territorio fue ocupado, al inicio de la década de 1960. En las inmediaciones de la aldea fue construida la sede de la Hacienda Suiá Missu en 1962. En 1966, los indios eran expulsados de su tierra y arrojados en otro pueblo a 400 kms.
En 1980, la Suiá Missu fue vendida a una empresa italiana, que durante Rio/92, presionada por las entidades brasileñas e italianas, se comprometió a devolver a los Xavantes 165.000 hectáreas.

Esto causó indignación en los agricultores y los políticos locales que, incluso en 1992, organizaron la invasión del área, quedándose con las mayores y mejores tierras y buscando familias sin-tierra o” posseiros” para ocupar la restante, para decir que la tierra tenia un destino social.

En 1993 la zona fue declarada Tierra Indígena. En 1998, ya demarcada, fue homologada por decreto del Presidente de la República. Aun así, los Xavantes sólo regresaron en 2004, promoviendo la ocupación de su propio territorio.

Desde 1995, medidas judiciales determinando, ya la retirada de los intrusos en la zona, ya la suspensión de la sentencia, se fueron sucediendo. En 2012, cuando la FUNAI y el Ministerio Público Federal (MPF) ya había presentado a la Justicia el plan de retirada de los intrusos para comenzar en octubre, un juez de la TRF-1, el 13 de septiembre, ordenó la suspensión de la acción. Por último, el 17 de octubre, el Supremo Tribunal Federal (STF) suspendió la anterior orden judicial y la Justicia Federal inició el 6 de noviembre, la entrega de citaciones para la retirada de los ocupantes ilegales de la tierra indígena. Un gran trabajo, con el apoyo de la Fuerza Nacional, la Policía Federal y el Ejército y, que se encuentra en la zona para hacer efectiva la decisión judicial.

La Coordinadora Nacional de la Comisión Pastoral de la Tierra (CPT) se alegra con la conclusión de este caso, pero no antes de darse cuenta de la diferencia de trato dispensado a los grupos indígenas y a otras comunidades tradicionales, frente a la propiedad. Lo de Maraiwatsede es emblemático. Los derechos de los pueblos indígenas y otras comunidades primitivas son apenas tolerados, pero para que se tornen efectivos, el camino por recorrer es largo y arduo.

La dilación indefinida de la resolución de conflictos parece ser una estrategia para socavar la resistencia de las comunidades. Se multiplican hasta el extremo los recursos judiciales, se niega la autenticidad de los documentos, se penen bajo sospecha los informes antropológicos y otras acciones semejantes. Se encuentran miles de subterfugios legales, admitidas por la justicia, para que los procesos, en especial los de el reconocimiento de las tierras, no caminen.

Por otro lado, los procesos que implican el “derecho de propiedad” son de una agilidad impresionante. A menudo, sin exigir documentos que acrediten la propiedad legal y sin escuchar a los que se verán afectados se emiten sentencias de recuperación de la propiedad que se realizan rápidamente, usando para ello todo el aparato coercitivo del Estado.

La Coordinadora Nacional de la CPT felicita a los Xavante de Maraiwatsede por su lucha persistente de resistencia, y presenta a la Prelatura de São Félix do Araguaia y de modo particular, a su obispo emérito, Mons. Pedro Casaldáliga, su solidaridad, sobre todo en este momento en que los ataques y las amenazas se suceden.
