La Comisión Europea de Derechos Humanos y Pueblos Ancestrales – Harald Edelstam, con sede y

Con fecha 27 de diciembre y en adelante, los medios de comunicación de Chile inician difusión de
campaña en contra de dos ciudadanas italianas a través de supuesta participación como activistas en
marcha no autorizada en Collipulli.

El Estado reconoce a través de los medios de comunicación que han venido, desde el 27 de diciembre,
evaluando la aplicación de expulsión del país de dos observadoras de derechos humanos, lo que aumenta
nuestra preocupación, ya que dicha evaluación se basa principalmente en la carta de presentación e
información enviada oficialmente al Ministerio de Relaciones Exteriores de Chile el 29 de noviembre
2012 en donde se informa a los siguientes correos la siguiente información: Dirección de Derechos

Se solicita tenga la amabilidad de hacer llegar la siguiente carta adjunta a los encargados de esta
instancia. De nuestra máxima consideración, las organizaciones que firman carta adjunta, nos dirigimos
a usted para informar sobre la labor de Derechos Humanos de IL Cerchio y CEDPHA - Edelstam. Por
consiguiente deseamos informarles de la llegada de dos ciudadanas italianas que irán a Chile como
observadoras de derechos humanos: Luisa Costalbano, educadora y Valentina Fabbri, Mediadora
Intercultural.

Con esto mencionamos que nuestra labor ha sido transparente y que las instancias informadas no ha
tenido la delicadeza de acusar recibo de esta información, aprovechándose de estos datos para intentar
crear un montaje de ciertas agitadoras, lo que es completamente equivocado. Las observadoras, como en
cualquier parte del mundo, apoyadas en el Derecho Internacional sobre Observadores de Derechos
Humanos, podrán estar presentes en todo lugar de conflicto para documentar y realizar sus informes.

Considerando que las declaraciones difundidas afectan a dos integrantes de nuestras organizaciones
debemos mencionar que en este momento, las observadoras están ejerciendo un trabajo de monitoreo y
observaciones de derechos humanos en territorio de la Araucanía y otras regiones de Chile.

Recordamos que las dos ciudadanas italianas ingresaron a Chile legalmente el 4 de diciembre 2012, a
través de policía internacional, no en calidad de turistas, sino como observadoras de Derechos Humanos,
el mismo dia 4 se presentaron ante la embajada italiana de Santiago según instrucciones y, posteriormente
asistieron a reunión planificada con la Delegación Permanente de la Unión Europea en la capital, a
quienes se informó su pertenencia a organizaciones que se ocupan de los derechos humanos y que
certifican su papel de observadoras internacionales de derechos humanos en territorio chileno y donde se
acuerda trabajo entre las observadoras y esta institución.

En relación a nuestras observadoras, cabe recordar que a su llegada a Santiago se reunieron con Beatriz
González, Policy officer de la Delegación de la Unión Europea, quedando concordado que antes de salir
de Chile entregaran informe respecto a la Observación de Derechos Humanos en terreno, cumpliendo de
este modo con la diplomacia y relación entre Instituciones y la sociedad civil.

En comunicación directa con nuestras observadoras, se nos ha informado de seguimiento de personas no
identificadas, como asi la presencia permanente de vehículos particulares de vigilancia, entre otros, por
personal de carabineros, datos confirmados por personas que viven en ese sector donde hospedaban ellas.
 
A través de los medios de comunicación hemos podido constatar que inicialmente se intento crear
situaciones de confusión, tergiversando casos de dos italianos expulsados del país el 2008 con las
presencia de nuestra observadoras. También hemos podido ver el trabajo de inteligencia del Estado de
Chile, al tratar de vincular supuestos financiamientos desde el extranjero, haciendo mención de
seguimiento historial de uno de los familiares de las observadoras, lo que sentimos como insulto a la
democracia y al derecho internacional. Ver noticia: Chile expulsó de su territorio a los ciudadanos

Cabe mencionar que Chile, incumple con acuerdos internacionales, así como la aplicación en su totalidad
del Convenio 169 de la OIT para pueblos Indígenas, en especial lo que refiere a la Consulta. Chile no esta
entregando protección a los observadores de Derechos Humanos, muy por el contrario se viene realizando
seguimiento y acoso ejercido por organismos del Estado en contra de estos.

Ante esto, hacemos un llamado a organizaciones que trabajan por los Derechos Humanos, a
personalidades políticas y civiles, tanto nacional e internacional a manifestar la preocupación por la
protección a observadores de derechos humanos que están en Chile.
Entre los instrumentos internacionales que mencionamos, deseamos destacar que:

En relación a la difusión de parte del historial personal de una de las observadoras, nos apoyamos en el
articulo 17 del Pacto Internacional de Derechos Civiles y Políticos: 1. Nadie será objeto de injerencias
arbitrarias o ilegales en su vida privada, su familia, su domicilio o su correspondencia, ni de ataques
ilegales a su honra y reputación. En referencia a las comunicaciones escritas por nuestras observadoras,
mencionamos que su y nuestro trabajo se basa fundamentalmente en el artículo 19 del mismo pacto: 1.

Nadie podrá ser molestado a causa de sus opiniones. 2. Toda persona tiene derecho a la libertad de
expresión; este derecho comprende la libertad de buscar, recibir y difundir informaciones e ideas de toda
índole, sin consideración de fronteras, ya sea oralmente, por escrito o en forma impresa o artística, o por
cualquier otro procedimiento de su elección.

Cuando se trata de la situación en la Araucanía, es importante destacar que en las declaraciones de dueños
de predios, estos particulares manifiestan abiertamente salir de cacerio, y tomar la ley en sus propias
manos, por tanto pensamos que todas difusión de esto sin que el estado chileno tome medidas
correspondientes, pudiese interpretarse como apología al odio nacional. Sobre esto citamos el Artículo
20; 2, Toda apología del odio nacional, racial o religioso que constituya incitación a la discriminación, la
hostilidad o la violencia estará prohibida por la ley.

Para finalizar mencionamos que según el artículo 14 de la convención Americana sobre Derechos
Humanos (Pacto de San José), nuestras observadoras tienen todo el derecho a que se rectifique toda
tergiversación de la información publicada hasta el momento. Artículo 14. 1. Toda persona afectada por
informaciones inexactas o agravantes, emitidas en su perjuicio a través de medios de difusión legalmente
reglamentados y que se dirijan al público en general, tiene derecho a efectuar por el mismo órgano de
difusión su rectificación o respuesta en las condiciones que establezca la ley.
