Conclusiones y recomendaciones para la dignidad de las mujeres que portan mercancías en las fronteras de Ceuta y Melilla, de las Jornadas “Porteadoras y Derechos Humanos en la Frontera de Ceuta”, celebradas en Tetuán los días 21 y 22 de abril de 2012.

 

Reunidas en Tetuán, las organizaciones abajo citadas queremos alertar a la opinión pública sobre la grave situación de las mujeres que portan mercancías en las fronteras de Ceuta y Melilla, a la vez que exigir a las autoridades competentes a todos los niveles que se tomen las medidas necesarias para respetar sud derechos y su dignidad.

 

Miles de mujeres cruzan diariamente la frontera desde Marruecos hacia Ceuta y Melilla para proveerse de mercancías en los polígonos fronterizos de ambas ciudades, transportándolos después en sentido contrario para entregarlos en Marruecos, en pesados fardos que pueden alcanzar hasta cien kilos de peso.

 

Las condiciones de este trasiego de mercancías tolerado, atípico o ilegal, son verdaderamente infrahumanas. Al enorme peso que transportan para conseguir una mayor remuneración en torno a los cinco euros por porte, se suman, como hemos podido constatar, la inhumanidad física del paso en sí, la frecuente violencia policial, el tener que efectuar pagos de soborno a la policía, los acosos sexuales o el requisamiento de la mercancía de forma arbitraria.

 

En su mayoría son mujeres solteras, viudas, repudiadas o divorciadas aunque también las hay casadas. Todas ellas, con una importante necesidad de conseguir ingresos económicos.

 

Su objetivo diario es pasar el mayor número de veces posible aunque solo lo consiguen  de dos a tres veces; no  hay tiempo para más porque la frontera se cierra al paso de mercancías sobre la una. Por cada paquete transportado una mujer cobra de 4 a 6 euros  dependiendo del peso que siempre supera los 50 kilos pero que puede llegar hasta los cien.

 

Las condiciones del paso provocan frecuentes avalanchas en las que a veces han muerto aplastadas algunas mujeres, como Zafia Azizi en noviembre de 2008 en Melilla o Bushra y Zhora,  en mayo de 2009, en la frontera de Ceuta. 

 

Un trasiego alegal de mercancías que reporta unos 1.400 millones de euros y que supone casi un tercio de la economía de ambas ciudades autónomas. De esta actividad viven directamente 45.000 personas en Marruecos y otras 400.000 indirectamente, según la Cámara de Comercio Americana de Casablanca. Además, supone una importante cantidad de ingresos a través del soborno (unos 90 millones de euros anuales según el Semanario Independiente marroquí Al-Ayam).

 

Las porteadoras deben sortear la violencia policial, salir ilesas de las avalanchas, soportar los golpes o el acoso sexual, pagar los sobornos, aguantar el frío, la lluvia o el calor extremo, llevar la carga y recibir las

directrices de quienes controlan el paso de mercancías y se enriquecen con él. Pero, sobre todo, deben intentar sobrevivir en unas fronteras donde la mercancía es la dueña del ser humano. Las porteadoras son el motor que mueve la economía a ambos lados de las fronteras entre Ceuta y Melilla y Marruecos pero nadie hace nada por  evitar la tragedia humana que su trabajo supone ni se preocupa por sus derechos y su dignidad.

 

DE ESTA FORMA CONSTATAMOS

Que se están produciendo gravísimas violaciones de los derechos humanos y de la dignidad de las personas en las fronteras de Ceuta y Melilla, y que se están vulnerando Tratados y Convenciones Internacionales de protección de tales derechos de las que tanto el Reino de España como el Reino de Marruecos son parte.

 

Y POR ELLO PLANTEAMOS A LA OPINIÓN PÚBLICA Y LAS AUTORIDADES COMPETENTES LAS

SIGUIENTES REFLEXIONES Y RECOMENDACIONES:

1.     Que ni las razones de estado ni los intereses económicos o políticos pueden estar por encima del respeto a los derechos humanos. Y esto alcanza también a las fronteras, puntos sensibles que no pueden obviar el cumplimiento de los Tratados Internacionales y la legislación humanitaria

2.     Que más allá de razones normativas que pudieran dificultarla, pero que nunca pueden estar por encima de los derechos humanos, sería importante habilitar mecanismos para que el tránsito de mercancías pudiera hacerse de forma que no perjudique tan gravemente la salud de estas mujeres

3.     Que para evitar situaciones trágicas o simplemente el acoso y el peligro que supone el tránsito por lugares no preparados para pasar con comodidad personas y fardos, es preciso modificar la estructura física de los túneles de paso. (he cambiado el orden y suprimido algo redundante)

4.     Que, en este mismo orden de cosas, también es necesario considerar la posibilidad de permitir el uso de medios mecánicos manuales para el porte de dichas mercancías.

5.     Que es imprescindible una acción decidida de las autoridades para acabar con los abusos policiales incompatibles con un estado de derecho: violencia, golpes, abusos, sobornos, medidas arbitrarias, requisamiento de mercancías sin motivo, etc., castigando, si es necesario, a los culpables de tales violencias pero, sobre todo, vigilando el respeto escrupuloso de la dignidad de las personas por parte de las fuerzas policiales.

6.     Que resulta imprescindible apostar por un desarrollo sostenible que tenga como prioridad las personas y el empleo digno en toda la zona. Ello evitaría que miles de mujeres se vean obligadas a un trabajo tan cruel e inhumano como el porteo de mercancías en las fronteras.
